Paul Fraser Collectibles is part of Just Collecting Limited.
These Conditions of Sale set out the terms under which Just Collecting Limited (the “Auctioneer”, “we”, “us”) conducts auctions and private sales of collectibles. By registering to bid, bidding, or otherwise participating in any auction (whether online-only, timed online, or live hybrid auctions with online and in-room bidding), you agree to be bound by these Conditions of Sale.
Just Collecting Limited acts as agent only for the Seller unless expressly stated otherwise. The contract for sale is made directly between the Buyer and the Seller. The Auctioneer shall not be liable for any default by either party.
1. Definitions
- Auction means any sale conducted by Just Collecting Limited, including online-only auctions, timed auctions, and live public auctions with online bidding.
- Buyer means the person whose bid is accepted.
- Buyer’s Premium means the percentage payable in addition to the Hammer Price.
- Hammer Price means the final bid accepted by the Auctioneer.
- Lot means any item or group of items offered for sale.
- Reserve means the confidential minimum price below which a Lot will not be sold.
- Seller means the owner of the Lot.
2. Examination and Description of Lots
2.1 All Lots are offered for sale “as is” and with all faults. Catalogue descriptions, images, estimates, and condition reports are statements of opinion only and are provided for guidance.
2.2 Illustrations may not represent the exact colour, condition, or scale of the Lot. No Lot may be rejected on the basis of illustration alone or for matters visible in catalogue images (including centring, margins, perforations, or mounting).
2.3 Estimates are not statements of value and do not constitute any representation that the Lot will sell at a particular price.
2.4 Buyers are strongly advised to examine Lots personally or to request condition reports prior to bidding. The absence of a condition report or a reference to defects does not imply that a Lot is free from faults, restoration, or alteration.
3. Bidding and Registration
3.1 All bidders must register prior to bidding and provide such identification, proof of address, and financial references as we may reasonably require. We reserve the right to refuse registration, impose bidding limits, or require deposits.
3.2 Bids may be placed in person, online, by telephone, or by written commission bid, subject to prior arrangement and our discretion.
3.3 All bids are binding and irrevocable once made.
3.4 In the event of identical bids, priority will normally be given in the following order: written bids received first, then live room bids, then telephone bids, then online bids, at the Auctioneer’s discretion.
3.5 Online and telephone bidding services are provided as a convenience only. The Auctioneer accepts no liability for errors, omissions, system failures, loss of internet connection, or failure to execute bids howsoever caused.
3.6 The Auctioneer has absolute discretion to refuse any bid, advance bidding in such increments as it sees fit, withdraw or divide any Lot, combine Lots, or re-offer any Lot in the event of error or dispute.
4. Bidding Increments
4.1 Bidding will normally advance in increments published in the catalogue or online, but the Auctioneer may vary increments at their discretion during the auction.
4.2 Bidding generally opens below the low estimate and advances in the following standard bidding increments:
- £1 – £20: by £1
- £20 – £50: by £2
- £50 – £100: by £5
- £100 – £200: by £10
- £200 – £500: by £20
- £500 – £1,000: by £50
- £1,000 – £2,000: by £100
- £2,000 – £5,000: by £200
- £5,000 – £10,000: by £500
- £10,000 – £20,000: by £1,000
- £20,000 – £50,000: by £2,000
- £50,000 – £100,000: by £5,000
- £100,000 – £200,000: by £10,000
- £200,000 – £500,000: by £20,000
- £500,000 – £1,000,000: by £50,000
- £1,000,000 or more: by £100,000
5. The Sale
5.1 A contract for sale is formed when the Auctioneer accepts the highest bid (fall of the hammer or close of timed auction), provided any Reserve has been met.
5.2 In addition to the Hammer Price, the Buyer shall pay a Buyer’s Premium of 25%.
5.3 Risk passes to the Buyer immediately upon the fall of the hammer or close of the auction. Title will not pass until payment has been received in full and cleared.
6. Payment
6.1 Payment of the full amount due (Hammer Price, Buyer’s Premium, postage, insurance, and any applicable taxes or duties) must be made within 7 days of the auction.
6.2 Accepted methods of payment include bank transfer and such other methods as notified prior to the sale. All bank charges are the responsibility of the Buyer.
6.3 Payment must be made by the registered Buyer. Third-party payments will not be accepted without prior written agreement.
6.4 The Auctioneer reserves the right to charge interest on overdue amounts at up to 1.5% per month, calculated daily.
7. Remedies for NonPayment
7.1 If payment is not received in full within the specified period, the Auctioneer may, without prejudice to any other rights:
- cancel the sale;
- resell the Lot publicly or privately;
- charge the Buyer for any shortfall, costs, commissions, and expenses arising from resale;
- exercise a lien over any property of the Buyer in our possession;
- refuse future bids or require a deposit for future auctions.
8. Postage, Packing, and Insurance
8.1 The Auctioneer will arrange packing and shipment as agent for the Buyer unless otherwise agreed.
8.2 Postage and packing will be charged at cost, based on the actual cost incurred for packing, insurance, and shipping to the Buyer’s specified destination.
8.3 Risk remains with the Buyer during transit. Insurance will be arranged where appropriate at cost, unless the Buyer instructs otherwise in writing.
8.4 The Buyer is responsible for compliance with all import/export regulations, customs restrictions, and payment of any duties or taxes. The Auctioneer accepts no responsibility for delays, seizures, or losses caused by customs authorities.
9. Collection and Storage
9.1 Lots will not be released until payment in full has been received.
9.2 Lots not collected or dispatched within 7 days may be subject to storage charges at a rate of £2 per item per day and remain entirely at the Buyer’s risk.
10. Authenticity and Claims
10.1 Any challenge to authenticity must be made in writing within 30 days of the auction and supported by a recognised expert certificate acceptable to the Auctioneer.
10.2 If a claim is upheld, the sale will be rescinded and the Hammer Price and Buyer’s Premium refunded. No other compensation shall be payable.
10.3 No claims will be accepted for collections, mixed lots, or lots described as such, nor for condition issues visible from the catalogue or images.
11. Limitation of Liability
11.1 Nothing in these Conditions limits liability for fraud or fraudulent misrepresentation.
11.2 Subject thereto, the Auctioneer shall not be liable for any indirect, consequential, or economic loss, loss of profits, or loss of opportunity.
12. Data Protection
Personal data will be processed in accordance with applicable Jersey data protection legislation and our privacy policy. We may share information with bidding platforms, payment processors, shippers, and (in cases of default) other auctioneers.
13. Copyright
All catalogue and online content, images, and descriptions remain the property of the Auctioneer and may not be reproduced without prior written consent.
14. Governing Law and Jurisdiction
These Conditions of Sale are governed by the laws of Jersey, Channel Islands, and the courts of Jersey shall have exclusive jurisdiction.
